Raf — Terms of Use

These Terms of Use ("Terms") govern your use of the mobile application and website operated under the name Raf (the "Service"). The Service is provided by Mert Günay, a sole proprietorship operating under the trade name "Raf" (Şile Tax Office, Tax No: 4270197158, address: Çavuş Mahallesi, Şile / Istanbul, Türkiye). In these Terms, "Raf", "we", "our" or "us" refers to this sole proprietorship; "Service" refers to the mobile application and the website.

By using the Service, registering an account, or purchasing a subscription through it, you confirm that you have read, understood, and agreed to be legally bound by these Terms together with our Privacy Policy. If you do not agree to these Terms, you must not use the Service and must remove the application from your device.

1. Definitions

Capitalized terms in this document have the following meanings:

  • Account: The personal record you create to access the Service.
  • Content: Any text, image, photo, comment, shelf, note, message, clan content, wish, or other data uploaded to or shared through the Service by you.
  • Premium: The auto-renewable paid subscription that unlocks certain features of Raf.
  • Device: The iOS or Android-powered mobile device through which you access the Service.
  • App Store: The Apple App Store operated by Apple Inc., and the Google Play Store operated by Google LLC.

2. Eligibility and Age Requirements

You must be at least 13 years of age to register for the Service. The Service is not directed to children under 13; if we determine that you are under 13, your account will be terminated and your data will be deleted in accordance with the procedure described in our Privacy Policy.

A Premium subscription is available only to users who are 18 years of age or older. Users between the ages of 13 and 18 may use the basic features of the Service but may not purchase a paid subscription. Use of the Service by minors must occur with the knowledge and consent of a parent or legal guardian.

By using the Service you represent that there is no legal impediment to your use of the Service in your jurisdiction and that you have not been convicted of any offense related to sexual abuse or harassment.

3. Account and Account Security

You agree to provide accurate, current, and complete information when creating an Account. You are responsible for maintaining the confidentiality of your username and password and for all activity that occurs under your Account.

If you become aware of any unauthorized use of your Account, you must immediately notify us at [email protected]. Your Account is non-transferable; you may not use another person's account or allow another person to use yours.

You may sign in to the Service using "Sign in with Apple" or "Sign in with Google". Use of these services is also subject to the terms of Apple Inc. and Google LLC respectively.

4. License Grant

Subject to your compliance with these Terms, Raf grants you a non-transferable, non-sublicensable, worldwide, non-exclusive, revocable license to use the Service for your personal, non-commercial purposes on Apple-branded products or Android devices that you own or control.

The license does not include the right to: copy, reproduce, create derivative works of, reverse-engineer, decompile, exploit commercially, rent, or resell the Service or any of its Content. Pursuant to Apple's Usage Rules, the Service may only be used on devices and under conditions permitted by Apple.

5. User Content and License

The Content you upload to the Service (posts, comments, shelves, notes, photos, messages, clan content) remains yours. To enable us to operate the Service — to deliver Content to other users, to back it up, and to improve the Service — you grant Raf a worldwide, royalty-free, sublicensable, non-exclusive license to use, store, copy, display, distribute, adapt, and reasonably modify (e.g., to optimize images) your Content. This license remains in effect until you delete the Content or close your Account, and terminates within a reasonable period thereafter (subject to backup copies and to derivative uses that cannot reasonably be removed).

We may display your Content within the Service in places such as Discover feeds, popular sections, and recommendation systems. This requires no additional permission. For external use of your Content (App Store screenshots, social media advertising, press kits, investor materials) we will request your explicit, written consent.

Use for AI / machine-learning training: Raf will not sell or transfer user Content to third parties for the purpose of training artificial intelligence models. We may use anonymized and aggregated data to improve the Service (recommendation quality, content filtering, fraud detection, search).

Direct messages (DMs): DMs on Raf are not end-to-end encrypted. Messages are stored on our servers in encrypted form (transit and at-rest encryption). Raf personnel may access messages only in the following cases: (i) review of a harassment, threat, illegal-content, or community-guideline complaint reported by one of the parties; (ii) court order or legal obligation; (iii) a critical security incident (account compromise, fraud investigation). All personnel access to DMs is audited and logged. We recommend that sensitive information (credit card numbers, passwords, government IDs, etc.) not be shared via DM.

6. Acceptable Use and Community Guidelines

When using the Service you agree not to:

  • Share content that violates law, public order, public morality, or third-party rights;
  • Engage in harassment, threats, hate speech, discrimination, racism, or bullying targeted at any individual or group;
  • Share any content that involves or promotes child sexual abuse or exploitation, or any sexually explicit content involving minors;
  • Engage in spam, deceptive advertising, fraud, phishing, pyramid or chain communications;
  • Share personal or sensitive data (address, telephone, government ID, credit card, bank account) without authorization;
  • Impersonate another person or entity in a misleading manner;
  • Upload Content that infringes copyright, trademark, patent, or other intellectual property rights; share pirated software, video, or audio, or links thereto;
  • Engage in activity that harms the Service infrastructure or interferes with its operation: spreading viruses or malware; attempting unauthorized access; running automated tools (bots, scrapers, crawlers) that overload the Service;
  • Attempt to gain unauthorized access to the Service's source code, APIs, or user data;
  • Resell the Service commercially or sublicense it without authorization;
  • Engage in illegal arms, drug, or controlled-substance transactions or advertising.

Violation of these guidelines may result in suspension or termination of your Account. In serious cases, Raf reserves the right to pursue legal remedies and to notify the appropriate authorities.

7. Premium Subscription

Raf offers an auto-renewable paid subscription called "Raf Premium". Premium is currently available through the iOS and Android mobile platforms; web subscriptions are not available at this time, and these Terms will be updated when web subscriptions become available.

Subscription disclosures (required by App Store and Google Play policies):

  • Subscription name: Raf Premium
  • Lengths: Monthly (1 month) and Yearly (12 months).
  • Pricing: Current pricing is shown in your local currency on the purchase screen. Apple App Store and Google Play Store may set prices according to local market conditions.
  • Free trial: A 1-week free trial may be offered to eligible new subscribers. If you do not cancel during the trial, the subscription will automatically convert to a paid subscription at the end of the trial period and the relevant fee will be charged. Eligibility for the free trial is determined by Apple or Google based on their criteria.
  • Auto-renewal: Unless cancelled at least 24 hours before the end of the current period, the subscription automatically renews for the same duration and is billed to the App Store / Google Play account on file. The renewal charge is processed within the final 24 hours of the current period.
  • Cancellation: You may cancel your subscription at any time on iOS via Settings → Apple Account → Subscriptions, or on Android via Google Play → Account → Payments & subscriptions → Subscriptions. Cancellation takes effect at the end of the current subscription period; you continue to enjoy Premium features for the remainder of that period.

The billing and renewal of a Premium subscription is tied to the store account (Apple Account or Google Account) through which it was purchased; a subscription purchased through Apple cannot be transferred to Google Play, and vice versa. However, the Premium entitlements and features granted by your subscription apply across all Raf platforms (iOS, Android, and any future web client) when you sign in with the same Raf account.

8. Refunds and Right of Withdrawal

Primary refund channel. Refund requests for Premium subscriptions must be processed through the platform on which the purchase was made:

  • iOS users: request a refund directly from Apple at reportaproblem.apple.com.
  • Android users: request a refund from Google via Order History → Report a problem in your Google Play account.

Statutory right of withdrawal for users residing in Türkiye. Pursuant to the Turkish Distance Contracts Regulation, you may exercise your right of withdrawal within 14 days of the start of a Premium subscription. If your refund request through Apple or Google is denied, you may write to [email protected] to invoke this withdrawal right; we will review your request within the time prescribed by the Distance Contracts Regulation and, where the conditions for the right of withdrawal are met, initiate the refund through Apple's or Google's refund mechanisms.

When you purchase a Premium subscription via the Apple App Store or Google Play flow, you are deemed to have expressly consented to the immediate performance of the service as part of that flow. A Premium subscription also qualifies as a service performed instantly in an electronic environment within the meaning of Article 15(ğ) of the Distance Contracts Regulation. Accordingly, pursuant to both Article 15(ğ) and Article 15(h), the right of withdrawal does not apply to services performed instantly in an electronic environment, nor to services whose performance has begun with the consumer's consent and that the consumer has actually started to use; therefore, once you have started using Premium features (e.g., crossing a Premium gate, selecting a Premium-only theme/color, viewing Premium Content), the right of withdrawal can no longer be exercised.

9. Content Moderation and Copyright Notices (DMCA)

Raf is not obligated to proactively monitor Content on the Service, but reserves the right, at its discretion, to remove or hide Content and to suspend Accounts that violate these Terms or our community guidelines.

If you are a copyright holder or an authorized representative thereof and believe that Content on the Service infringes your copyright, please send a notice to [email protected] including: (i) the rightsholder's full name and contact information; (ii) a description of the work alleged to have been infringed; (iii) the location of the infringing Content on the Service (URL, username, etc.); (iv) a statement of good-faith belief that the use is unauthorized and that the information provided is accurate; (v) your signature (a scanned copy of a wet-ink signed document, or a secure electronic signature within the meaning of Turkish Law No. 5070 on Electronic Signatures, is acceptable).

Upon a valid notice, Raf will take reasonable steps within a reasonable time to disable access to or remove the Content and may notify the user who uploaded it. Counter-notice rights are reserved.

10. Account Termination

You may close your Account at any time from within the application via Settings → Account → Delete My Account. Account-deletion procedures and data-retention periods are described in detail in the Privacy Policy (in summary: a 30-day recovery window followed by permanent deletion).

Raf may suspend or permanently terminate your Account if (i) you violate these Terms or our community guidelines, (ii) we are required to do so by law, (iii) it is necessary to protect the security of the Service or its users, (iv) the Account has been inactive for 24 months or more, or (v) there is a suspicion of fraud. In serious cases these actions may be taken without prior notice.

Termination for breach of these Terms does not entitle you to a refund of any remaining Premium subscription period; however, applicable Turkish consumer-law rights are preserved.

11. Maintenance and Support

Maintenance and support for the Service are solely the responsibility of Raf. Apple Inc., Google LLC, and the manufacturers of devices have no obligation whatsoever to furnish maintenance or support services for the Service. Support requests may be sent to [email protected].

12. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by applicable law, Raf disclaims all express or implied warranties, including warranties that the Service will be uninterrupted, error-free, virus-free, fit for a particular purpose, or will meet your expectations. To the extent the Service does not perform as warranted, our liability shall not exceed the limit set out in Section 14, except as required by applicable law.

In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service if applicable. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Raf.

For purchases made through Google Play, refund and warranty claims are subject to Google Play's refund policy and are processed through Google.

13. Third-Party Services and Content Sources

The Service draws on third-party metadata sources to populate film, TV, and book information (such as TMDB, Open Library, IMDb, Google Books) and relies on third-party infrastructure providers (Cloudflare, Google Firebase, Apple Inc., Google LLC) for functionality such as push notifications, crash reporting, performance monitoring, and file hosting. These third-party services are subject to their own terms and privacy policies; Raf is not responsible for the accuracy of third-party metadata or for the operation of third-party services. Details of the data flows are described in the Privacy Policy.

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Raf be liable for any indirect, incidental, consequential, special, or punitive damages (including but not limited to loss of profits, loss of data, or loss of reputation). Raf's total aggregate liability arising out of or relating to these Terms or your use of the Service shall not exceed the amount you paid Raf for a Premium subscription during the 12 months preceding the event giving rise to the claim; in the absence of a Premium subscription, this cap is the Turkish Lira equivalent of USD 50.

Nothing in this Section limits any rights granted to consumers under the Turkish Consumer Protection Law or other applicable mandatory consumer protections.

Force majeure. Raf shall not be liable for any interruption or delay in the Service caused by events beyond its reasonable control and that are unavoidable in nature, including but not limited to acts of God, earthquake, war, terrorism, pandemic, public-authority orders, failures of internet infrastructure or power grid, outages of third-party cloud service providers, cyber attacks, and distributed denial-of-service (DDoS) attacks. In such an event, Raf will use reasonable efforts to mitigate the impact and to restore the Service within a reasonable time.

15. Intellectual Property and Third-Party Claims

The Service and the software, designs, trademarks, and Content owned by Raf are protected by copyright, trademark, and other intellectual property laws. Other than the limited license expressly granted in these Terms, nothing in these Terms transfers any intellectual property rights to you.

In the event of any third-party claim alleging that the Service or your possession or use of the Service infringes that third party's intellectual property rights, the investigation, defense, settlement, and discharge of any such claim is the sole responsibility of Raf. Apple Inc. and Google LLC have no obligation to investigate, defend, settle, or discharge any such claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless Raf, its employees, agents, and service providers from and against any and all third-party or governmental claims, actions, costs (including reasonable attorneys' fees), damages, and expenses arising out of (i) your use of the Service, (ii) your Content, (iii) your breach of these Terms, or (iv) your infringement of any third-party rights.

17. Export and Sanctions Compliance

By using the Service you represent and warrant that (i) you are not located in, nor a national or resident of, any country designated by the U.S. Treasury Department as subject to economic sanctions; (ii) you are not on the U.S. Treasury Department's "Specially Designated Nationals" list, the U.S. Department of Commerce's "Denied Persons", "Entity", or "Unverified" lists, or any equivalent list under any applicable sanctions regime. It is your responsibility not to use the Service in violation of applicable export laws.

19. Compliance with Third-Party Terms

When using the Service, you agree to comply with applicable third-party terms, including without limitation the Apple Media Services Terms and Conditions where applicable.

20. Apple as Third-Party Beneficiary

With respect to a copy of the Service obtained through the Apple App Store, these Terms are entered into solely between you and Raf; Apple Inc. is not a party to these Terms. Notwithstanding the foregoing, you and Raf acknowledge that Apple Inc. and Apple Inc.'s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple Inc. will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

21. Changes to These Terms

Raf may update these Terms from time to time in response to changes in law, new features, business needs, or security requirements. Material changes will be communicated at least 30 days before they take effect, via in-app notification and/or to the email address associated with your Account. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may close your Account.

22. Severability

If any provision of these Terms is held to be invalid or unenforceable by a competent court, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.

23. Assignment

You may not assign your rights or obligations under these Terms without Raf's prior written consent. Raf may assign its rights and obligations under these Terms to its affiliates or to a successor in connection with a sale of its business, merger, or reorganization.

24. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye.

Consumers may submit complaints to the Consumer Arbitration Committee or the Consumer Courts in their place of residence. This is a statutory right and may not be limited by these Terms. For non-consumer disputes, the Istanbul (Anatolian Side) Courts and Enforcement Offices shall have exclusive jurisdiction.

Mediation. Pursuant to Turkish Law No. 7036 on Mediation in Civil Disputes, prior recourse to mediation is a statutory precondition to filing a lawsuit in commercial disputes; the parties accordingly agree to first attempt to resolve any commercial dispute through mediation. This requirement does not apply to consumer disputes; consumers may apply directly to the Consumer Arbitration Committee or the Consumer Courts.

Disputes arising directly out of purchases made through the App Store (payment, billing, invoicing) are subject to the terms and dispute- resolution procedures of Apple Inc. or Google LLC, as applicable.

25. Term

These Terms take effect between you and Raf when you start using the Service and remain in effect for as long as your Account is active. Provisions that by their nature should survive termination — in particular Section 5 (User Content license), Section 14 (Limitation of Liability), Section 16 (Indemnification), and Section 24 (Governing Law and Dispute Resolution) — shall survive termination of these Terms.
